Traffic Violation Penalties in Colorado

Many traffic violations are infractions that can penalize you with:

  • Fines paid to the state or county
  • Marks on your driving record
  • Mandatory traffic school attendance

However, you should remember that you can lose your driver’s license for an extended period of time if you get too many marks on your driving record. The fines you are ordered to pay can also escalate for subsequent infractions.

Are Traffic Violations Misdemeanors?

A traffic violation can be considered a class 1 or 2 misdemeanor in Colorado. Misdemeanors will be recorded on your criminal record and can include incarceration as part of any sentencing requirements. In other words, you need to be ready to defend yourself from a traffic offense charge, and our Denver traffic ticket lawyers can help.

Examples of Traffic Infractions in Colorado

There is a truly extensive list of traffic infractions in Colorado. Our highly experienced Denver traffic violation defense lawyers are familiar with them all, so you don’t have to do the research on your own. Using our insight and knowledge, we can find holes in the argument against you, such as reasons why the misjudged your driving behavior that would invalidate the ticket or charge.

To name only a handful of the more common traffic infractions:

  • Driving an unsafe vehicle: You can be ticketed for driving an automobile deemed unsafe. Your vehicle could be unsafe if it has missing headlights, ineffective brakes, loose parts, etc. You will have to properly maintain your vehicle or prove why you do not have to funds to do so.
  • Driving under the influence (DUI): An adult driver with a blood alcohol concentration (BAC) level between 0.02 and 0.05 might not be charged with a misdemeanor DUI, but they can still be ticketed for a class A traffic infraction that carries its own penalties.
  • Failing to yield right-of-way: A large percentage of all traffic infractions recorded in Colorado involve failing to yield the right-of-way, either to other motorists or pedestrians. Although, interpreting the right-of-way can be difficult in high traffic situations, and the officer who ticketed you could have feasibly misunderstood what they saw.
  • Following too closely: Tailgating is the more common term for “following too closely.” Maintaining at least a two-second gap between your vehicle and the one in front of you should be an adequate distance. However, the statute is vaguer, requiring you to follow a “reasonable and prudent” distance, which is open to some interpretation.
  • Misuse of a wireless telephone: Texting while driving is technically considered the “misuse of a wireless telephone,” a serious infraction in Colorado. Drivers under the age of 18 are not permitted to use a cellphone for any reason while behind the wheel.
  • Obstruction of driving mechanisms: You can be ticketed for driving your vehicle while objects or clutter are near, on, or around the driving mechanisms, like the steering wheel, gearshift, and pedals. Essentially, if you have a messy car, then you could get a ticket.
  • Speeding: Driving faster than the posted speed limit is an infraction if you do not drive faster than 24 miles per hour than the limit. Beyond that amount will constitute a misdemeanor traffic violation. The same is true if you drive faster than 75 miles per hour on the highway.

This list of traffic violations in Colorado is in no way comprehensive. No matter what traffic violation citation, ticket, or charge you are facing, though, you can count on Springer & Steinberg, P.C. and our Denver traffic ticket attorneys for reliable representation. We will act as if we are representing ourselves when working on your case to best pursue an optimal outcome.
